Hindraf's Waytha seeks debate with Perkasa

By Joe Fernandez

KOTA KINABALU: Hindraf Makkal Sakthi will invite Perkasa chief Ibrahim Ali and his most prominent supporter, Dr Mahathir Mohamad, to a conference on Article 153 of the Federal Constitution, which it plans to hold in the British Parliament.

“This will be a chance for the duo to flog their racist cause before the world once and for all,” said Kelantan-born Hindraf chief Waythamoorthy Ponnusamy, who is in exile in Britain.

Speaking to FMT by telephone from Singapore, he said the proposed conference would also prove de facto Law Minister Mohd Nazri Abdul Aziz wrong about Article 153.

Nazri recently said the article could not be questioned and that it was because Waythamoorthy had broken this taboo that he could not be allowed back in the country.

“I did not merely question Article 153,” said Waythamoorthy. “I have repeatedly called for it to be scrapped.”

He said the proposed conference will see “a distinguished gathering of Queen’s counsel” debating Article 153 within the full scope of the Federal Constitution and declassified documents pertaining to the Merdeka talks.

“Hindraf will be holding talks with two QCs from the Doughty Street Chamber on April 6 in London in preparation for the conference,” he said.

“We have not finalised whether the conference will be in the House of Commons or the House of Lords, but most probably the latter.”

The conference will discuss at least four topics:

* Special Malay privileges is a myth created by Umno’s propaganda machine and does not exist in Article 153;

* Article 153 also covers the legitimate aspirations of the non-Malay communities besides mentioning the natives of Sabah and Sarawak and the Malays;

* The powers of the King over Article 153 have been systematically usurped by Umno as a party and government since independence in 1957 and this must be viewed as treason; and

* Article 153 was supposed to be scrapped 15 years after independence.

Declassified papers

Waythamoorthy said he would also invite the Attorrney-General “to state the Malaysian government’s position before the international community”.

He rejected a comparison between Hindraf and Perkasa and the allegation that both are racist organisations.

“It doesn’t mean that we are racist just because we talk about the plight of the Indians all the time,” he said. “We are only seeking our rights under the Federal Constitution which have been denied us. We are not out to deprive anyone of his place in the sun, unlike Perkasa, although they will deny it like all racists.”

He does not rule out participation in the London conference by apolitical groups like the Common Interest Group Malaysia (CigMa) headed by Jeffrey Kitingan and various Orang Asli associations who were involved in a rare demonstration recently in Putrajaya.

However, he said, he saw little point in Umno taking part in the conference since the party, he alleged, had out-sourced its racist ideology to Perkasa in order to stay relevant in the ruling Barisan Nasional coalition.

“We are going to prove through the conference that Umno has been misleading everybody on Article 153 and taking them for a ride,” he said. “We will easily establish this. We are backed by the Federal Constitution, including Article 153, and the declassified papers on the Merdeka talks.”

He pointed out that the declassified papers, although still considered official secrets in Malaysia, were no longer so in Britain.

The bottomline is that Hindraf wants Article 153 scrapped but would consider supporting a new article guaranteeing protection for the underprivileged of all races.

“The weakness of the present Article 153 is that it has been ignored and the legitimate aspirations of the non-Malay communities have been legislated against subsequently by Umno and institutionalised in various forms to discriminate against them,” fumed Waythamoorthy.

He conceded that the Malays, as well as the natives of Sabah and Sarawak, were still claiming that they were backward and needed affirmative action by the state.

“Over one trillion ringgit was poured into the Malay economy alone under the New Economic Policy,” he said. “It’s time that the Malays stood up as a community and asked their leaders what happened to the money. Why isn’t it in their pockets?”

Hindraf to debate Article 153 - in British Parliament - Malaysiakini

The debate over Article 153 of the Federal Constitution pertaining to the definition of 'bumiputera' may shift overseas from Malaysia's Dewan Rakyat to the British Parliament, if efforts by Hindraf chief P Waythamoorthy come to fruition.

hindraf in london 110310 waythamoorthyAccording to Waythamoorthy (right), a gathering of the Queen's Counsels (QC) will debate Article 153 in light of declassified documents on the talks held between Tunku Abdul Rahman and officials of the British government pertaining to Merdeka.

While other details of the conference have not been finalised - it has yet to be determined whether the event will be in the House of Commons or the House of Lords - discussions are ongoing with QCs from Doughty Street Chamber, said Waythamoorthy.

The agenda for the conference, he added, will include debates on

- the issue of special Malay privileges and whether or not it is a “myth” created by Umno

- the aspirations of non-Malay communities who are not included in Article 153's classification of 'bumiputera' (Malays and the natives of Sabah and Sarawak

- the powers of the King in relation to Article 153

- whether Article 153 should be scrapped

“We will invite Perkasa chief Ibrahim Ali and his mentor Dr Mahathir Mohamad to participate in the conference,” Waythamoorthy when contacted by Malaysiakini.

“We would definitely want the Attorney-General of Malaysia (Abdul Gani Patail) to be there as well to state the Malaysian government's position before the international community,” he added.

The issue of Article 153 was raised recently when Minister in the Prime Minister's Department Mohd Nazri Abdul Aziz told Parliament that 'bumiputera' in the constitution referred to the Malays, the natives of East Malaysia and the Orang Asli of Peninsula Malaysia.

jahai orang asli kelantan tualang story 200409 01Some have opined that as Article 153 refer only to two categories of communities, the Malays and the Orang Asal of Sabah and Sarawak, the Orang Asli are not included in the definition and, therefore, not considered to be in the category of those accorded 'special privileges'.

Given Waythamoorthy's call for Article 153 as a whole to be scrapped, however, Nazri said this reason alone compromises the former's right to return to Malaysia.

Waythamoorthy, in self-imposed exile in London, has been granted asylum by the British government.

hindraf london demo 060208 waythamoorthyWaythamoorthy said he does not rule out the participation in the conference of groups such as the Common Interest Group Malaysia headed by Jeffrey Gapari Kitingan as well as some Orang Asli associations.

Asked what he hoped to accomplish with holding a conference so far away from Malaysian shores, Waythamoorthy said such a discussion would never be allowed back home.

There is also the complication of his passport being revoked, he added, preventing him from traveling to Malaysia.

“What we are going to prove through the conference is that Umno has been misleading everybody on Article 153 and taking them for a ride,” said Waythamoorthy.

“We will easily establish this during the conference. We are backed by the Federal Constitution, including Article 153 and the declassified papers on the Merdeka talks,” he added.

'Show me the money'

In place of the current Article 153 should be a new provision addressing the 'underclass' of all Malaysians, said Waythamoorthy.

Until that is done, he asserted, the current law “denies us our rightful place in the sun.”

It also means non-Malay Muslims can seek its 'privileges' through the “backdoor” and claim to be Malays and natives”.

bagan pinang 081009 indian voters“There is no basis in law for a non-native to claim that he's now a native by the backdoor method of professing Islam and claiming to be a constitutional Malay,” stressed Waythamoorthy.

On the other hand, there remain 'genuine' Malays throughout the country and natives in Sabah and Sarawak who are claiming to have been overlooked and ignored by the government and the New Economic Policy (NEP), he said further.

“It's time that the Malays and Sabahan and Sarawakian natives stand up and ask their leaders what has happened to the money (allocated by the NEP). Why isn't it in their pockets?” he asked.

What is the stand of PKR & PAS on this, please ask the leaders not the mandores? it would be interesting how they see this if HINDRAF embarks in its journey to clarify the true meaning and intention of the Article 153 as oppose to what UMNO keeps parroting to fill its own coffer rather than public interest. My guess, they will keep quiet, as usual worried about the vote bank not the public.

Dear Mr Waytha sir, Brilliant job. You are doing what no one else would dare to even think of. Way to go sir. Your move will put many things in their right perspective. It may be a long journey but a fantastic move. You have added spice to your move by inviting Ibrahim, Mahathir and the AG to face the international community. I wonder, how they are going to face the situation if they come at all but like I said earlier, it will open up a whole new horizon. KUDOS to you sir, we are all with you.... observer.....?????

Waytha Thambi, pls play fair, you know Ibrahim does not have the english to debate at an international forum so why call him just to belittle him. Actually article 153 can be very good if it is not abused. Actually Malaysia is very well endowed by God.Rubber, tin, oil palm, petroleum semua ada. No natural disaster. Yet why NEP has failed to eradicate hard core poverty among malays, the answer lies in mahathir's 22 yrs of missrule.NEP was abused to enrich cronies and in some instances there was overzealous implementation like the johore civil service which is nearly 100% malay. In brunei they don't have income tax nor hard core poverty, we should be richer than brunei. Ask Che det lah who lost money at maminco and when mohamad nor was bank negara chairman how much money we lost at forex, not to mention money lost through AP. M'Sia started losing money to a bottomless pit through crony contracts and OSA. This is the real enemy of the people.

UMNO has hijacked, and pirated almost everything that can be hijacked and pirated. The judiciary, Petronas money(our money), the NEP(Tun Razak meant it to be an upliftment of all the disadvantaged and poor, irrespective of race), and not only of article 153. When independence was proclaimed, if I know my history well, all communities will guaranteed their rights, and that their culture, language, and way of life is guaranteed. But UMNO has hijacked all this, and has chosen to interpret what was not in the spirit of independence. They keep on harping on "special rights"(only God knows what this means), the "social contract"(if it ever existed in the first place. Can anyone prove that there was a social contract?). It is hard to believe that the constitutiion, drawn up by the British, and other Commonwealth countries, will draw up a racist, discriminatory, and apartheid constitution. Please UMNO, MCA, MIC and the Bar council, elaborate further on this.

The way I understand it, there can never be reconciliation between Pakatan and Hindraf unless they agree to scrapping Article 153. So it's gonna take a while. Meaning, it is up to Pakatan to articulate their position unambiguously! Meanwhile, let us not waste time with Hulu Selangor - rapproachment is not going to take place. IOW, the seat is BN's.

Way to go Waytha!. It's time someone bring home the truth that UMNO pirates have been using article 153 to loot the country all for themselves. Pribumi means = Orang Asli, Kadazan, Iban and other natives. The rest of Malaysians are immigrants from Indon, China and India. Article 153 has used as back door entrance for mamaks and the likes to become 'native' and access to the juice!

Let's invite all to this debate to understand how those "good Muslims" in UMNO have fooled the entire Rakyat since 1969 through an impotent muzzled Press and a cowed emasculated Judiciary. So hat's off to Mr Waythamoorthy, for this and that smart plan to sue the British Government for failing in their duty to ensure that all in their former colony were protected as equal citizens under the Constitution they wrote for a democratic Malaysia. 2.""Given Waythamoorthy's call for Article 153 as a whole to be scrapped..Nazri said this reason alone compromises the former's right to return to Malaysia." HRP puts off decision, keeps 'em guessing - Malaysiakini

Yet-to-be-registered Human Rights Party have not decided on whether to join the fray in the Hulu Selangor by-election.

Pro-tem secretary-general P Uthayakumar (below) said the party's central committee was supposed to make a decision today, but the meeting has been postponed to a later date.

hindraf btn 151209 uthayakumar"We have deferred the meeting to a later date to do further research and get more information on Hulu Selangor," he said when contacted this afternoon.

Uthayakumar also said that the decision would be made public within a week.

The interest in HRP's foray into the by-election has been further fuelled by Kota Alam Shah state assemblyperson M Manoharan, who yesterday urged PKR to field Uthayakumar as Pakatan Rakyat's candidate.

PKR's Indian leaders, however, have given mixed reactions to the prospects of Uthayakumar riding on PKR's back in the by-election.

MIC has since confirmed that their number 2 man, G Palanivel, would be BN's candidate for the contest.

Hulu Selangor parliament seat fell vacant following the death of its representative, Dr Zainal Abidin Ahmad three days ago.

Ganabatirau and Vasanthakumar

The constituency in the northern region of Selangor has 63,593 voters, of which 19 percent are Indians. Malays make up the majority with 53.9 percent, and Chinese, 26.7 percent.

NONEMeanwhile, today's edition of Tamil daily Malaysia Nanban said that the appearance of former Internal Security Act detainees V Ganabatirau and K Vasanthakumar - both former comrades of Uthayakumar - in the Kuala Kubu Bharu campaign rally with PKR supremo Anwar Ibrahim has increased speculation that one of them may be fielded as the PKR candidate.

Ganabatirau is a DAP member whereas Vasanthakumar submitted his membership form to join PKR during the Bukit Selambau by-election.

Manoharan urges PKR to field Uthaya

Kota Alam Shah assemblyperson M Manoharan today proposed that Human Rights Party leader P Uthayakumar be picked as the PKR candidate in the Hulu Selangor by-election.

He argued that Indian support for Pakatan Rakyat is fast eroding and thus the best candidate for the parliamentary seat would be Uthayakumar as he can attract the sizable Indian votes in the mixed constituency.

"It is a good opportunity for Pakatan Rakyat to bring him on our side as he would be an asset to our coalition," said Manoharan, who won his state seat for DAP at the 2008 general elections while he was detained under the Internal Security Act.

The lawyer-cum-politician was held for about 18 months alongside Uthayakumar and three other Hindraf (Hindu Rights Action Front) activists.

In justifying his choice, Manoharan said that PKR supremo Anwar Ibrahim should explore long-term measures to secure Indian votes in the next general elections.

hindraf btn 151209 manoharan uthayakumarAccording to Manoharan (left in photo), Pakatan has nothing to lose by fielding Uthayakumar (right in photo) as a candidate.

Uthayakumar and his yet-to-be-registered HRP have been firing potshots at PKR and Pakatan for their failures in addressing issues affecting the Indian community.

Manoharan conceded that Uthayakumar has trained his guns at PKR over the past year, but he was optimistic that his fellow Hindraf activist can work together with Pakatan.

"Make him an ally not a foe as he knows how to resolve the Indian community's problem," said Manoharan.

Uthayakumar to consider

Uthayakumar has unveiled plans to contest 15 parliamentary and 42 state seats, all of which boast substantial Indian voters. This includes seats held by Pakatan's Indian politicians.

azlanMeanwhile, Uthayakumar was coy when asked to comment on Manoharan's suggestion.

"If I am given the leeway to bring about changes in regards to the critical Indian community problems, I will consider," he told Malaysiakini.

The Hulu Selangor seat fell vacant following the death of its incumbent representative, Dr Zainal Abidin Ahmad, two days ago. The Election Commission will announce the date of the by-election next Friday.

Indian Malaysians comprise about 19 percent of the 63,593 voters in the semi-urban constituency, which is located north of Selangor.

HRP hightlights plight of Indians to foreign missions

By Marc Jitab - Free Malaysia Today

KUALA LUMPUR: Twelve foreign and diplomatic missions were today given a briefing by the Human Rights Party (HRP) on human rights violations against ethnic minority Malaysian Indians.

HRP's pro tem secretary-general P Uthayakumar presented a laundry list of human rights failures and abuses in a 42-page report at the HRP headquarters in Bangsar here.

HRP, the political arm of the outlawed Hindraf organisation, appealed to foreign governments to internationalise the problems faced by Malaysian Indians.

Among the violations, Uthayakumar listed out police brutality, denial of education, forced religious conversions, housing and land issues, and lack of governmental funding.

Participants at the briefing were also shown grim pictures of victims who were abused, shot or thrown into the river, whose bodies were decomposed.

Uthayakumar said he had no choice but take the matter to the international arena as neither of the two main political coalitions in Malaysia served the interests of these minorities.

“The Malaysian Indian Congress (MIC) is just a showpiece of the government. There are 150,000 Indian children without birth certificates.

"If MIC can't even help provide them a simple thing as a piece of paper to show they are Malaysians, how can it solve the other problems?" he asked.

Uthayakumar did not spare the Pakatan-led state governments, saying that they are not doing any better either.

"At a stroke of a pen, the Penang, Selangor and Kedah governments can approve land for Tamil schools and the federal government will be compelled to enforce it.

"But it's been two years since they came into power, and nothing has moved,” said Uthayakumar, who is HRP's legal adviser.

Uthayakumar's days to freely champion HRP's cause may be numbered as there is a sedition trial hanging over his head. His prospects, according to his lawyer N Surindran, is grim.

With Hindraf banned and HRP yet to be registered, Uthayakumar's attempt to reach out to the international community to get Indian voices heard, seems understandable.

Hindraf accuses Umno of abusing Article 153

By Athi Shankar - Free Malaysia Today

GEORGE TOWN: Hindu Rights Action Force (Hindraf) has accused top Umno leaders of manipulating Article 153 of the Federal Constitution to amass the country’s wealth and enrich themselves.

London-based Hindraf supremo P Waytha Moorthy said Umno had disseminated misinformation for over 50 years, since independence, on the real contents of Article 153 to hoodwink Malaysians and misappropriate the country’s wealth by deception.

He said Article 153 never mentioned special privileges of Malays.

“It only stated the special position and provision of the Malays, read together with those of natives of Sabah and Sarawak and legitimate interests of all Malaysians.

“Umno invented the phantom privileges to empower and enrich the party elites,” he pointed out.

But, he alleged that Umno leaders over the years have propagated wrong information to deceive and cheat the people into believing that Article 153 was all about such phantom privileges.

He said Umno's top leaders have constantly and consistently spread misinformation on these phantom Malay privileges in order to loot and plunder the country’s wealth to enrich themselves at the expenses of other Malaysians, including the poor Malays and Indians.

“For instance, Umno had taken total control of Petronas money, a nation’s wealth, even evading parliamentary scrutiny,” he noted.

Racist policy

He said Umno leaders manipulated Article 153 to usurp the powers of Rulers to ensure the ruling elites were rich and powerful.

Waytha Moorthy alleged that Umno leaders misrepresented Article 153 to instil fear among non-Malays that “bloodbath would take place if the phantom special privileges of Malays were questioned”.

“Umno leaders have consistently warned non-Malays about the May 13 racial riot,” he told FMT via telephone.

He accused Umno leaders of abusing Article 153 to carry out a racist policy to upgrade a particular race – the Malays.

He said this blatant violation of human rights was systematically executed at the expense of non-Malays, especially poor and underprivileged Indians, Orang Asli (indigenous people) and natives of Sabah and Sarawak.

Waythamoorthy, a lawyer by profession, said Article 153 clearly stated that “it shall be the responsibility of the Yang di-Pertuan Agong to safeguard the special position of the Malays and natives of any of the States of Sabah and Sarawak and the legitimate interests of other communities”.

“Malaysians shall note that the article did not mention special privileges. It stresses that the King’s constitutional duty is to safeguard the legitimate interests of all Malaysians.

“Hindraf wants to know what the Yang di-Pertuan has done so far and will do in future to safeguard the interests of all Malaysians, not just Malays,” he said.

Legitimate interests

He added that Hindraf was curious to know what has been the “titah baginda” (ruler’s command) to safeguard the legitimate interests of all Malaysians.

The Hindraf leader had his international Malaysian passport revoked by the Home Ministry in late 2008.

Since then, Waytha Moorthy has been living under British political asylum.

Recently, the Umno-controlled Putrajaya administration announced that Waytha Moorthy would not be allowed back into the country because of his campaign to amend Article 153.

Hindraf considers the government'’s decision a serious violation of its leader’s legitimate citizenry rights.

Waytha Moorthy questioned the Umno-led Barisan Nasional government's fear of amending Article 153 when the same administration had amended the Federal Constitution countless times since 1957.

“The constitution only has 181 articles, but Umno had willfully amended it over 500 times, a world record, to suit its political whims and fancies,” he said.

He said the Umno administration had committed treason when the party embarked on constitutional amendments to clip the royal powers during the constitutional crisis in 1983 and 1989.

He said Hindraf wanted Article 153 to be amended to safeguard and enhance the legitimate interests, rights and benefits of all Malaysians irrespective of their ethnic and religious backgrounds.

“What’s so sacred about Article 153 that it shall not be amended?” he asked.
